Marquette, MI -(Great Lakes Radio News) – The family of an Alger County man shot and killed by a Munising Police officer is moving ahead with a civil suit against the officer involved.

Ronald and Cheryle Mitchell, parents of Timothy Mitchell, who was shot following a high-speed chase in July, have hired attorney Geoffrey Fieger, who plans to sue in federal court for a civil rights violation.

The lawsuit is expected to be filed in the next week or so.

It will ask for civil damages of a minimum of $75,000 and claims the officer used excessive deadly force.

Reports say the officer tried to arrest Mitchell after Mitchell crashed his vehicle.

With a pistol drawn, the officer repeatedly ordered Mitchell to the ground, but Mitchell continued to aggressively advance toward the officer.

Mitchell was shot twice in the chest.
